1. Acknowledgment and Consent

These Terms and Conditions set out the rights and obligations of all users regarding the use of the Velo (velotype.app) macOS Application and its associated web services. By downloading, accessing, or using the Service, You agree to be bound by these Terms.

You represent that you are over the age of 18. Velo (velotype.app) does not permit those under 18 to use the Service without appropriate legal oversight.

2. macOS System Permissions

Velo (velotype.app) is a native macOS application that requires deliberate system-level permissions to function. By installing Velo (velotype.app), you agree to grant the following permissions when prompted by macOS:

• Microphone (AVFoundation): Required to capture local audio streams for dictation.
• Accessibility & Input Monitoring: Required to globally detect your custom hotkey (e.g., the `Option ⌥` key) across the operating system and to simulate keyboard inputs (via pasting and `CGEvent` injection) directly into your active windows.

3. Subscriptions, Tokens, and BYOK Operations

Application Subscriptions & Free Model

Velo (velotype.app) provides a completely free local model for on-device dictation. We do not charge for tokens or backend processing in this mode. For users who wish to unlock premium features and capabilities of the macOS application itself, we operate on a tiered subscription framework handled via our Merchant of Record, Lemon Squeezy. These subscription fees apply exclusively to the usage of the application's premium features.

Bring Your Own Key (BYOK)

Velo (velotype.app) software allows you to bypass our token limits by directly connecting your own third-party API keys (including but not limited to OpenAI, Groq, Anthropic, Google, DeepSeek, GLM, Grok, Kimi, Qwen, and OpenRouter). When utilizing a BYOK workflow, you acknowledge that Velo (velotype.app) is acting solely as a pass-through application. You are solely liable for any usage fees, rate-limit penalties, or terms-of-service violations incurred directly with those third-party providers. Velo (velotype.app) assumes zero financial liability for API costs generated by your connected keys.

4. Content Ownership and Fair Use Policy

When utilizing the completely free local and offline model provided by Velo (velotype.app), You retain full and complete ownership of the text outputs and dictations injected into your hardware. However, when You choose to connect and route your dictations through third-party APIs (such as OpenAI, Anthropic, Groq, Google, DeepSeek, or OpenRouter), the ownership, retention, and usage rights of your data are entirely governed by that specific third-party provider's Terms of Service and Privacy Policy. Velo (velotype.app) has no control over, and assumes no responsibility for, how those third-party providers collect, store, or utilize the data they receive.

You also agree to strictly adhere to the following Fair Use restrictions regarding the Velo (velotype.app) application itself:

• No Malicious Injection: You may not utilize Velo's system-wide text injection mechanics to execute automated spam protocols, denial-of-service simulations, or malicious scripting against other software.
• Compliance with AI Providers: If using third-party APIs, You must abide by the safety policies established by the AI models you connect.

5. "AS IS" Disclaimer and Limitation of Liability

Velo (velotype.app) is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. We make no guarantees that the voice-to-text algorithms will be 100% accurate, or that the application will function without interruption across all future macOS software updates.

In no event shall Velo (velotype.app), nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data corruption, or business interruption, arising from your inability to access the Service or unauthorized access to your specific API keys.

6. Termination

We may terminate or suspend Your Account or access to the application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to utilize the cloud features and subscription benefits of Velo (velotype.app) will cease immediately.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to its conflict of law provisions. By continuing to use Velo (velotype.app), You agree to these Terms and any subsequent material modifications.
